EU DPA declares Google Analytics illegal because it runs on US cloud providers. Fathom is a Canadian company, and all of your EU traffic never leaves German-owned servers.

I’m not in the EU, do I need to sign your DPA?

We can't offer legal advice but we can talk around the purpose of the DPA. Basically, if you are subject to the GDPR (aka you process website traffic from anyone in the EU), you should sign it. If your website doesn’t ever process data from people in the EU, then you do not need to sign it.

That said, our DPA is optional, meaning you can still use Fathom whether or not you sign it. As with anything legal in nature, it’s best to talk to your lawyers about this if you aren’t sure.

It’s also important to note that whether or not you sign our DPA, we still process your EU website visitor data and traffic in accordance with the DPA (using our EU Isolation technology).
